just got a letter in my camping mag the the rules have been changed in Scotland now that it has been challenged there has never been a conviction for any one wild camping in any off the no overnight parking areas as it was deemed illegal as no permission was ever given for the signs to be erected or any law upholding it

Great news, in some areas alternative options can be few and far between.

Does the mag cite the relevant legislation? Something for the glovebox...

But I would think that you could be charged for obstruction for staying overnight in a passing place on a single track road. These I believe are demmed to be part of the road itself. It all depends on where you park.

Input from police members on here is common sense prevails, this may change as local councils take on more of a 'Law Enforcement' role, read 'Revenue Raising'.

Obviously blocking a passing place deserves a ticket, but overnighting in a huge lay by is surely road safety.

Exactly no ones talking here about causing an obstruction

You would think that the councils would be better spending their money providing Gypsy camps, the people that these laybye restrictions are really aimed at. Problem is that no one wants a Gypsy camp near their house.
