It is very clear by your pictures that this should not have past MOTT 4 weeks ago without even an advisory, you need to contact the station that carried out the test first as it was their test report that basically made you buy this vehicle . If you don't get any joy with them advise them that your next step is

It's a stretch but, assuming a kosher MOT in the first place, I wonder if the tester considered those areas to be non structural? The cross-member ties to the rails inboard of these bits. Would still be a fail where I take mine but with the new rules you should at least have got an advisory.

The garage that I said I called this morning, was the tester. He did say if it not structural it wouldn't of failed. There are also x2 holes either side of the front cross member which in my opinion must be structural. Also a fuel leak and abs warning light (which even I know is an automatic fail)

I was abit convinced the seller knew the garage or tester. But iv spoke and messaged him threatening to go to VOSA unless he wants to talk about a full or satisfactory partial refund, with no joy.

Its quite simple REPORT this, these people are a danger to the public . I don't think if you submitted it again they would Pass this vehicle after what you now know . Its a no brainer REPORT.
And please Do Not drive this vehicle until you have had a full safety check done, in particular the lower wishbones they tend to corrode badly and Snap.

OK, the rear is marginal but the front cross-member is a fail. ABS is also a fail.

I won't be using it, until it take it to the testers garage. But I will more than likely report it to vosa regardless of what he has to say for himself.

There's a lot of this about. Friendly garage passes trader's vehicle on the nod. There used to be a points based penalty system for these guys but they don't seem worried nowadays.
I wish you the best of luck with it. Don't forget a trader has obligations under the Consumer Rights Act 2015.

Thanks. I bought it through ebay privately so pretty sure I have no recourse there. I'll see what the test garage says. Failing that its going to get expensive. I have another friend who fabricates and restores all manner of cars. Mainly Austins so fingers xd he can perhaps help me out.

Oh, I see. Yes, private sale means having to prove it was not as described or the seller knew about the faults. Most sellers know no more than most buyers so it may be best to eat this one and sort it yourself.
On the bright side, unless it's just come off the boat, a lot of 'em look like this underneath so at least you'll have peace of mind when it's done. I bought the first one I saw that had a rear cross-member made of steel rather than a waxoyl/rust/steel composite material. Then I got it home and ended up doing a top-end rebuild
Only safe way is to drop +10K on a Japanese virgin but where's the fun in that?

Thankyou, that's somewhat comforting. It's my first one, bought with some money left to me by my nan who passed away. So it's struck a nerve!
Hopefully shes not a write of and I can get it sorted out soon.

Going back to the original intention of this thread, can I put in another strong recommendation for Dave (Kloonsy) at BongoWorx (aka Bongo Body Shop) in Barnsley. They have done a very thorough job on replacing my wheel arches and repairing inner sills and rear crossmember. If you've serious work needed they aren't going to be able do it immediately, so allow for getting it booked it in well ahead of when it's needed. I struggled to find their contact details at first, best to ring Dave's mobile 07584 134811. Oh, and if you've visited them before they've moved - just round the corner!

Was very impressed with Dave's work when I visited a few years back. Would have taken mine there except its my everyday drive so couldnt be without it for long.

I've just ordered some new rear arches from Bongo Spares and am looking for any recommendations for body shops in the Keighley area for fitting and respraying.
On my last Bongo a mate did both sides for £950, but he doesn't have the premises to do it any more. Bongo Spares quoted around £850 a side.
My wife popped in to a place in Keighley yesterday and was quoted £500 for the lot! He said he'd never worked on a Bongo before, so I'm a little nervous. Is it a job any competent specialist should be okay with?
I won't mind trying a few other place for quotes before I book it in, so any advice welcome.

A few pics from the mission so far the wheel arches of course needed doing so working rearward along the Sills on driver side Cut the exterior arch metal back to new about 2 inches but had to carve masses of the inner arch away which is a complete bastard of a shape in out up down curving one way then another I had to put in 7 separate panels I’ll post that picture when I get my sanity back
